The Ultimate Spring Break Giveaway Giveaway Official Rules
1. NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED. Enter online only from December 26, 2009 through February 11, 2010. Entries must be received before 11:59 pm February 11, 2010. One entry per person or email address per day.
2. Description of prize. Entrants will have the opportunity to win one (1) five night stay certificate valid for stays from February 26, 2010 through April 1, 2010 at the Boardwalk Beach Resort in Panama City Beach, Florida, four (4) Panamanaic cards, free entry at all Boardwalk-based events and activities during the say, and a welcome basket. Other restrictions may apply. Sponsor will not replace any lost, mutilated, or stolen certificates.
3. This giveaway is open to legal United States citizens in the 48 contiguous states, 18 years of age and older, who are active students at college or university. Employees of Royal American Hospitality, Inc., (“Sponsor”) and its parent companies, affiliates, as well as the immediate family members (spouse, parents, siblings and children) and household members of each such employee, are not eligible.
4. One winner(s) will be selected at random from all eligible entrants on or about February 12, 2010. This is a game of chance. Odds of winning are based on eligible number of entries. The selection will be final and binding. The winner will be notified by mail and/or by email on or about February 12, 2010. If the Sponsor does not receive a response within 48 hours, it may disqualify the entry and select an alternate winner. Return of any prize notification as undeliverable will result in disqualification and selection of an alternate winner.
5. Approximate retail value: $1,500.00. All prizes will be awarded. Actual value may vary based on availability and seasonality. The winner will not receive the difference between actual and approximate retail value.
6. No transfers, substitutions in prizes or cash will be allowed except by Sponsor, who may substitute a prize of equal or greater value.
7. The winner must comply with all instructions in the prize notification letter, including the completion of an affidavit and liability/publicity release, and return them within fifteen days of the date on the prize notification letter; otherwise prize will be forfeited and an alternate winner will be selected. By entering and/or by accepting a prize, you agree to be bound by these rules and to release Sponsor from any and all liability arising out of your participation in this Sweepstakes with respect to the awarding, receipt, use and/or misuse of any prize.
8. Liability for any applicable taxes will be the sole responsibility of the winner. Any required tax reporting forms will be furnished to the Internal Revenue Service. All expenses not specifically provided for by Sponsors in these rules are the sole responsibility of the winner.
9. Entries that are lost, late, illegible or incomplete for any reason will not be eligible. Sponsor reserve the right to modify or terminate this Sweepstakes or disqualify any entry in the event of technical impairment by computer virus or otherwise. In the event of early termination, Sponsor will randomly select winners from all eligible entries received at time of termination. In the event of a dispute concerning the identity of the person submitting an entry, the entry will be deemed to be submitted by the person in whose name the email account is registered.
10. All winners lists will be posted online when following the individual sweepstakes notification date.
BY ENTERING THE GIVEAWAY, participants release and hold harmless Sponsor, and its parent companies, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss, or damage of any kind arising from or in connection with this Giveaway or any prize won, including any injuries, loss or damage of any kind arising from or in connection with participation in the Giveaway. Sponsor is not responsible for any typographical or other error in the printing of this offer, administration of the Giveaway or in the announcement of prizes. In the event Sponsor is prevented from continuing with this Giveaway, or the integrity and/or feasibility of the Giveaway is undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel, or terminate the Giveaway without further obligation and, if so, Sponsor reserves the right, but not the obligation, to award the prize from among all valid and eligible entries received up to the time of such Force Majeure event. All entries are the property of Sponsor and are not returnable. Any action relating to this giveaway shall be initiated only in the state and federal courts located in Panama City, Florida (USA).
ONLINE REGISTRATION: This Giveaway is intended for viewing in the United States only and shall be construed and evaluated according to U.S. law. Do not enter this Giveaway if you are not located in the 48 contiguous United States or if you are not a legal U.S. resident. Repetitive automated electronic submission of entries is specifically prohibited, and any such entries will be disqualified. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, including any error that may result in an erroneous appearance of qualification for a prize. Sponsor is not responsible for any problem or technical malfunction of any computer equipment or software that results in loss of entry. WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY COMPUTERIZED SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGE FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
